Terms of Sale and Use

1This agreement

These terms are the agreement between you and IAH.FIT Inc., a Delaware corporation with its principal operations in San Antonio, Texas, which owns and runs nathanislove.com. In these terms, “we” and “us” mean that company, and “you” means the person using the site.

Using the site, making a piece, or buying anything here means you accept these terms. If you do not accept them, do not use the site.

2Nathan, and what you are talking to

Nathan McCrorey is a real artist. The voice that answers you on this site is a model built with his participation and shaped by his own body of work. It is not Nathan typing. Every reply it gives and every piece it paints is generated by software.

He has licensed his name, his style and his catalogue to us so this can exist. That licence stays with us. It does not pass to you.

3Who may use this site

You may make a piece if you are 13 or older. You may buy something only if you are 18 or older and able to enter a contract where you live. If you are buying for a company, you are telling us you are allowed to bind it.

4What you may ask for

The words you bring must be yours to give, and must not infringe anybody’s rights.

Keep them at a PG-13 standard. No profanity, sexual content, hate, harassment, graphic violence, drugs or alcohol. No likenesses of real people, including yourself. Nothing unlawful, and nothing that asks the model to imitate another living artist by name.

We may decline any request, refuse a sale, or stop a piece part way through. If you have already paid and we decline, we refund you in full.

5What gets made

You say how you want to feel. One piece comes back. We do not paint the same piece twice, and we do not sell yours to anybody else.

The piece is an interpretation of what you said, not an illustration of it, and never a portrait. If you ask for a likeness of a real person, you will be told no. Nothing on this site is a promise that the result will contain any particular subject, colour or shape.

6What you may do with your piece

When you buy a piece, we grant you an exclusive, perpetual, worldwide licence to that specific image. Print it, wear it, frame it, post it, sell work that carries it. Exclusive means we will not license that same image to anybody else, ever.

It is a licence, not a transfer of copyright. It covers that one image and nothing else. It gives you no rights in Nathan’s style, the model that made it, his name, or any other piece.

We keep the right to show your piece as an example of the work, here and in our own marketing. If you would rather we did not, write to legal@hitzero.com and we will stop.

7What stays ours

The site, the software behind it, the model, the name Nathan McCrorey, and every piece we have not sold you remain ours or Nathan’s. Nothing here gives you permission to copy the site, scrape it, take it apart, or use it to train a model of your own.

8Orders, prices and payment

Prices are in US dollars and shown before you pay. Sales tax is added where the law requires it. Prices can change, but the price you saw at checkout is the price you pay.

Stripe handles the payment. Your full card number never reaches us. Your bank statement will show NATHANISLOVE. An order is accepted when we send you a confirmation, not when you click pay.

9Making and shipping your shirt

Every garment is printed to order by a third-party print partner. Nothing sits in a warehouse waiting for you. Colours and sizes are as shown at checkout, and printed colour varies slightly from what a screen shows.

Printing takes a few business days before your parcel ships. Shipping windows after that are estimates, not promises.

If a parcel goes missing on the way, that is ours to fix. Tell us within 30 days of the estimated delivery date and we will send another at no cost to you. If the address you gave us was wrong or incomplete and the parcel comes back to us, we will send it again once you give us the right one, and the second postage is yours.

Import duties and customs charges, where they apply, are yours.

10Damaged, defective or wrong

Because each item is made to order and carries artwork that exists only once, it cannot be restocked or resold. So returns and exchanges are limited to items that arrive damaged, defective, misprinted, or different from what you ordered.

Send a photo to support@hitzero.com within 30 days of delivery and we will reprint it or refund you, whichever you prefer. Keep the item; there is nothing to send back.

A size that does not fit is not a defect, and neither is changing your mind. Because the shirt was made for you and carries artwork that exists only once, we cannot take it back and sell it to somebody else. Check the size guide before you order.

None of this limits rights your local consumer law gives you.

11When we cancel

We may cancel an order and refund you if we cannot make the piece, if the request breaks Section 4, if the price was obviously wrong, or if we suspect fraud. If we take your money and cannot deliver, you get it back.

12The site itself

We may change, suspend or close the site, and we may change what it offers, at any time. Painting depends on systems that can be slow or unavailable, and we do not promise the site will be uninterrupted or error free.

13No warranty

The site and everything on it are provided as they are and as available, without warranty of any kind. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing. Some places do not allow these exclusions, in which case they do not apply to you.

14The limit of our liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, however caused.

Our total liability for any claim connected to this site or anything you buy on it will not exceed the greater of what you paid us in the twelve months before the claim, or one hundred US dollars.

Nothing here limits liability that cannot be limited by law, including for fraud, or for death or personal injury caused by negligence.

15If you cause us a claim

You agree to cover us for any claim, loss or cost that comes out of your use of the site, the words you brought, or your breach of these terms, including reasonable legal fees.

16Disputes

Read this section. It affects how any dispute between us is decided.

First, write to us. Send a description of the problem to legal@hitzero.com. Most things end here. If we have not resolved it within sixty days, either of us may go to arbitration.

Any dispute that is not resolved that way will be settled by binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, before one arbitrator, in Bexar County, Texas, or somewhere we both agree. The Federal Arbitration Act governs this section. Either of us may still bring an individual claim in small claims court.

Claims are brought individually. Neither of us may bring a class, collective or representative action, and the arbitrator may not combine claims. If that is found unenforceable for a particular claim, this whole section does not apply to that claim, and it goes to the courts named in Section 17.

You can opt out. Write to legal@hitzero.com within thirty days of first accepting these terms, say you are opting out of arbitration, and this section will not apply to you. Opting out costs you nothing else.

17Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

For anything not going to arbitration, we both agree to the exclusive jurisdiction of the state and federal courts in Bexar County, Texas.

18Changes to these terms

When these terms change we change the date at the top of this page. The version live at the moment you buy is the one that governs your purchase. Continuing to use the site after a change means you accept it.

19The rest

If any part of these terms is unenforceable, the rest still stands. Not enforcing something once does not waive it. You may not transfer this agreement; we may transfer it to a company that takes over this business. These terms, and the privacy notice, are the whole agreement between us about the site. Sections 6, 7, and 13 through 17 survive the end of this agreement.
